Terms and Conditions (GTC)
1) 1) Scope:
The following terms and conditions apply to all purchase agreements concluded by us as the seller with our customers. These are subject to any amendments currently valid at the time of order. In placing an order these terms are formally accepted. The text can be downloaded or printed on your computer. Any variations to these conditions by the buyer are only admissible with the expressly written confirmation by the seller. The Conditions in the current version also form the basis for all future sales contracts between us and the buyer.

By placing an order the buyer declares that he is of legal age, with full legal competence, and that all personal data provided are truthful and correct.
3) Contract:
The customer's order constitutes a binding offer to conclude a purchase contract. The purchase contract is concluded once the customer's payment has been received in the seller’s account. The seller reserves the right to refuse a sales contract, in particular in the case of interim price increases or erroneous mistakes on our website www.authalverlag.at, in our sales brochures and/or price lists. We assume no liability for such errors or price changes.
In case the seller fails to ship the goods or an order confirmation within 14 days, the period of commitment will be deemed to have expired and no purchase contract concluded. A full refund of all amounts transferred will be made to the customer.
4) Purchase price:
A valid purchase price is one which is currently displayed on our website, in our current price list or brochure. Prices include Austrian VAT but exclude shipping costs, packaging, import duties, etc. If, owing to price changes by our suppliers, changes in statutory VAT, typing errors, misprints, or calculation errors of a price, these result in an increase of more than 20 percent, either the buyer or the seller may cancel the purchase contract.
5) Shipping costs:
For deliveries within Austria, the following shipping charges are applicable:
Orders up to €40 in value - delivery
€5.00
Orders over €40 in value - delivery FREE
For shipments to Germany and
Switzerland, regardless of value of the order - delivery fee €15.00.
For deliveries to the rest of Europe, regardless of value of the order - delivery fee €20.00
6) Delivery:
a) For goods in stock shipment will be made within 5 working days of receipt of payment. Normal postal delivery times have to be taken into consideration after dispatch from warehouse.
b.) In case we are unable to complete a contract owing to the non-availability of the goods, the customer will be informed immediately we become aware. Customer claims for inability to fulfill a contract are not accepted.
c.) Delivery will be made to the address specified by the buyer. Any costs arising as a result of incorrect, unclear or incomplete information will be the responsibility of the buyer.
d.) The seller is entitled to make part-shipments. Any additional costs incurred as a result of this will be borne by the seller.
e.) Shipment of goods will be made by post or by private delivery company.

9) Warranty & Compensation
a) In the event of a valid claim for errors the statutory provisions for compensation will apply. However, the seller is initially entitled to exchange or replace any rejected goods. If the seller is unable to provide a replacement, the customer is entitled to demand a price reduction or cancellation of the purchase contract. Any further claims are excluded. Costs for the return of goods and shipping costs for any replacement are to be borne by the seller.
b) Claims for damages, in particular compensation for consequential damages, other indirect damages and/or losses or loss of profits caused by errors of late or non-delivery with the exception of personal injury, will only be considered in the case of damages arising from wilful or gross negligence.
c.) No liability will be accepted for damage sustained during transportation. Such claims are to be referred to the delivering company
d.) The seller is not liable for any technical
disruption to the use of the website.
e) Furthermore, the seller assumes no liability for the content of the sales item and in particular for technical or content accuracy or the legality of any statements contained therein, for any
text, images, instructions, or formulations.
10) Disclaimer:
Authal Verlag or its owner expressly dissociate themselves from the contents of other websites that may be reached via links on our homepage. These links are for information only. They are made available without prejudice and this does not signify that their content represents the opinion of the publisher or its owners. Furthermore, the publisher or the owner dissociate themselves from the content of such pages if any part is contradictory to any prevailing legislation. In such cases the owners of such websites are solely responsible.
11) Withdrawal rights for distance-selling consumers:
A buyer who is a consumer has the right to withdraw from the contract within 7 working days of receipt of goods. Customers abroad have a 14-day right of withdrawal. A withdrawal shall be deemed timely if the buyer’s notice of cancellation is sent either electronically or by other means within this time limit and at the same time the goods are returned to the seller in their original packaging and without any traces of use.
The removal of books from their packaging in order to browse or check for errors is accepted. For any other use we reserve the right to debit you for the value of such use or any depreciation in value.
In the case of a cancellation by the buyer along with the return of the goods all advance payments made will be refunded. Furthermore, the buyer shall bear the cost of the return shipment.
12) Data protection:
The seller is bound to a duty of confidentiality by the Data Protection Act. Customer data will not be disclosed to third parties. The buyer submits personal data (name, address, email address, date of birth, etc. ......) voluntarily. In doing so the buyer consents to his data being stored by the seller for the use of order processing, customer records, and payment settlement. Furthermore, the buyer consents to his data being used by the seller for information or advertising purposes. This consent may be revoked by the customer at any time.
13) Third party rights - copyright:
No part of the products offered may be reproduced (e.g. copying, scanning, etc.), copied, or distributed without the written permission of the publisher. The customer acknowledges that the design of the website and all published articles on offer via internet in the Webshop (e.g. extracts, tables of contents) as well as all external logos, images and graphics displayed are protected by copyright and may therefore not be duplicated or distributed. All rights reserved.
14) Final provisions:
Only Austrian law (excluding the CISG and conflict rule) is applicable; the place of performance is Baden, place of jurisdiction is acknowledged to be by the competent court in 2500 Baden, so far as no other compulsory place of jurisdiction exists.
Should any of these terms and conditions not conform to statutory regulations, the remaining provisions of these terms and conditions still remain valid.
